Terms & Conditions of Sale and Warranty

By purchasing from Scialla Motor Scooters, you agree to the following terms and conditions regarding your scooter purchase, restoration, and warranty.

Sales Policy

By this point, you are familiar with our restoration process. Please be aware that all sales are final. We do not accept returns on scooters.

• Deposits: Any deposit made for a scooter is non-refundable, including cases where the restoration process takes longer than initially estimated.

• Shipping Issues: Any damage, discrepancies, or missing items during delivery must be reported directly to the shipping agent. Scialla Motor Scooters is not responsible for shipping-related issues. Claims will only be accepted if they are documented at the time of delivery.

• Condition of the Scooter: You are purchasing a used, reconditioned, classic two-stroke scooter, which inherently requires some level of effort to operate and maintain. It is your responsibility to inspect and make any necessary adjustments before use. This may include tasks such as cleaning the gas tank, adjusting carburetion, or tightening bolts.

• Liability: Scialla Motor Scooters is not liable for any costs associated with accidents or damages resulting from the use of the scooter. You assume full responsibility for the safe operation of the scooter.

• Parts and Expenses: We will not cover the cost of parts, repairs, or expenses unless specifically approved by us in advance.

Limited Warranty

We offer a 2-year warranty on all new parts. If any new part is found to be defective within this period, we will replace it at our expense. However, labor costs and other expenses related to part replacement are not covered, as they are beyond our control. Please note that used or reconditioned parts are not covered under this warranty, as we cannot predict their durability.

Covered Components

This warranty applies to the following parts, provided the failure is not due to normal wear and tear or neglect:

• Fuel System: Fuel Pressure Regulator, Fuel Injectors, Carburetor, Fuel Pump

• Electrical System: Alternator, Regulator/Rectifier, Engine Control Module, Ignition Coils

• Engine Components: Crankshaft, Cylinder Heads, Camshafts, Cylinders

• Brakes: Calipers, Reservoirs

• Exhaust: Muffler, Exhaust Pipe, Variable Exhaust Control

• Chassis: Forks, Shocks, Swing Arm

Excluded Components

This warranty excludes the following components:

• Any parts not listed under Covered Components

• Items subject to normal wear and tear, including tires, batteries, audio equipment, accessories, and expendable maintenance items (e.g., spark plugs, filters, belts, lubricants)

• The engine and main frame, due to their age and inherent condition

Warranty Claim Process

To initiate a warranty claim for any covered component, you must notify Scialla Motor Scooters promptly. Any repair work should not commence before you receive authorization from us. Scialla Motor Scooters reserves the right to inspect the vehicle, determine the cause of failure, and specify a service provider for repairs. We may reject claims where the failure is caused by neglect, normal wear and tear, or any condition not covered by the warranty.

If we determine that a covered component has failed due to a mechanical defect, we will provide a replacement part free of charge. However, the warranty does not cover any installation costs, diagnosis, or downtime during the repair process.

Forum, Venue, and Jurisdiction

By purchasing a scooter from Scialla Motor Scooters, you agree that the enforcement of this warranty and any claims arising from it will be governed by the laws of Vietnam. Any legal actions related to this warranty must be filed in a court of competent jurisdiction within Vietnam.

Severability

In the event that any provision of this warranty is deemed unenforceable by a court of competent jurisdiction, that provision will be severed, and the remaining terms will continue in full force and effect. This provision will not affect any other agreements between you and Scialla Motor Scooters, including the purchase agreement or any financial obligations.

By purchasing from Scialla Motor Scooters, you acknowledge that you have read, understood, and agree to the terms of this Limited Warranty as outlined above.
